Becoming
THE BECOMING RETREAT AGREEMENT
This Agreement (“Agreement”) is made effective as of purchase date between ESSENTIAL FUEL COACHING (“Company”) represented by AMY GOREY (“Coach”) and purchaser.
1. TERMS
This Agreement details the “THE BECOMING RETREAT” in Sedona, Arizona, taking place from April 24-27, 2025. The Retreat includes three dinners, two lunches, three breakfasts, snacks, accommodations, workshops, excursions, and coaching. Other activities may be included at the Coach's discretion.
Client is responsible for any additional costs for lodging, transportation, food, or other items not specified above. Client must inform the Coach of any dietary restrictions at least 14 days before the Retreat.
2. PAYMENT TERMS
Payments are non-refundable. If Client cancels, the Coach may offer attendance at a future event at their discretion.
3. DISCLAIMERS
The Coach and guest speakers are not providing medical, psychological, legal, or financial advice. Information provided by the Coach is not an endorsement, and the Coach is not liable for any adverse effects from it. The Coach may suggest third-party services, but is not responsible for any consequences arising from those services. Testimonials are not guarantees of specific outcomes.
4. CLIENT RESPONSIBILITY; NO GUARANTEES
Client is responsible for their results and acknowledges no guarantees of specific outcomes from the Retreat. The Coach does not make representations or warranties regarding Client’s performance.
5. INTELLECTUAL PROPERTY
The Coach retains all intellectual property rights to materials created for the Retreat. No rights are transferred to the Client except for those explicitly stated.
6. RELEASE
The Coach may record photographs, videos, and audio during the Retreat and use the Client's likeness for promotional purposes without limitation.
7. LIABILITY WAIVER & ASSUMPTION OF RISK
Client assumes all risks related to health, injury, or death during the Retreat and releases the Coach from liability. Client is also responsible for their safety and property. In case of injury or illness requiring emergency medical treatment, Client agrees to be financially responsible for any costs incurred. Client acknowledges inherent risks associated with COVID-19 and accepts all risks associated with it, including health risks and potential exposure.
8. MEDICAL & HEALTH CONDITIONS
Client must inform the Coach of any medical conditions, allergies, or medications before the Retreat. The Coach is not responsible for health issues arising from undisclosed conditions.
9. INTERNET ACCESS & SECURITY
Wi-Fi access is not guaranteed, and the Coach is not responsible for any illegal activities conducted using the internet during the Retreat.
10. ADDITIONAL CONSENT & RELEASE PERMISSIONS
Client consents to the use of photographs, video, and audio recordings for promotional purposes by the Coach.
11. TRAVEL DOCUMENTATION & INSURANCE
Client is responsible for ensuring they have all necessary travel documentation, insurance, and arrives on time. The Coach is not liable for any travel-related issues.
12. TRANSPORT
The Coach is not responsible for any transportation delays or cancellations.
13. HEALTH & SAFETY REGULATIONS
Client must comply with all health and safety regulations. The Coach is not liable for injuries during Retreat activities.
14. LOSS OR DAMAGE
The Coach is not responsible for lost or damaged personal belongings.
15. LIABILITIES
The Coach is not liable for failures due to events beyond their control, including natural disasters, war, or other uncontrollable situations.
16. DISCLAIMER OF WARRANTIES
The Retreat and related activities are provided “as-is” with no warranties of any kind.
17. FORCE MAJEURE
If circumstances beyond either party’s control (e.g., natural disasters, pandemic, etc.) make performance impossible, the affected party’s obligations will be delayed without liability.
18. OTHER
The Coach reserves the right to modify or cancel the Retreat, with the option to reschedule for a future date.
19. NON-DISPARAGEMENT
The Parties agree not to disparage each other or make negative statements about the Retreat or Coach.
20. DISPUTE RESOLUTION
If a dispute arises, it will be submitted to the American Arbitration Association in Olympia, Washington. The decision will be binding.
21. GOVERNING LAW
This Agreement is governed by the laws of Washington State, USA.
22. GOOD FAITH
Both parties agree to act in good faith in the negotiation, execution, and performance of this Agreement.
23. ENTIRE AGREEMENT
This Agreement supersedes all prior agreements and may only be modified in writing.
The Parties have executed this Agreement as of the Effective Date.
